The EB-2 NIW (National Interest Waiver) visa is an employment-based immigration category for individuals with advanced degrees or exceptional abilities. Additionally, applicants for the EB-2 NIW visa can request a waiver of the specific job offer requirement or labor certification (PERM) if they can demonstrate that their residency in the United States will benefit the national interest.

There are no statutory requirements for qualifying efforts to be granted a national interest waiver. Instead, USCIS evaluates the following three factors:
